Terms and Conditions of Sale

These Terms and Conditions (“Terms”) govern all sales of products (“Products”) by The Charmé Edit (“we”, “us”, “our”) to the purchaser (“Customer”, “you”). By placing an order, you agree to be bound by these Terms.

1. Orders

1.1 All orders are subject to acceptance by The Charmé Edit. We reserve the right to reject any order at our discretion.

1.2 Orders are confirmed only once payment in full has been received.

1.3 It is the Customer’s responsibility to ensure all details (including shipping address, device model, and order specifications) are correct before submitting the order.

2. Prices and Payment

2.1 Prices are listed in GBP (£) and include UK VAT where applicable.

2.2 We cover U.S. customs duties, so customers won’t need to pay any extra fees upon delivery.

2.3 Other international Customers (Outside UK and US) are responsible for all import duties, taxes, and customs clearance fees applicable in their country. If such charges are refused or unpaid, resulting in a return to us, reshipment will only be made once additional shipping costs are covered.

2.3 Original shipping costs are non-refundable except where the Product is faulty.

3. Production and Delivery

3.1 Many of our Products, including all phone cases, are made to order. Production is typically completed between five (5) to seven (7) business days prior to dispatch. While we endeavour to meet this timeframe, on occasion additional time may be required due to factors such as material availability, seasonal demand, or other unforeseen circumstances. In such cases, The Charmé Edit will inform the Customer promptly and provide an updated estimated dispatch date.

3.2 Delivery times provided at checkout are estimates only and do not constitute a guarantee.

3.3 Risk of loss or damage passes to the Customer once the Products are dispatched from The Charmé Edit’s premises. From dispatch until delivery, the Customer bears all risk of loss or damage arising from courier handling, delays, or failure to accept delivery.

3.4 Where parcels are left outside the delivery address or with a neighbour at the Customer’s request, such Products are left entirely at the Customer’s risk.

3.5 If a parcel is returned to us due to incorrect address, non-collection, or unpaid duties, Products that are made-to-order are not eligible for refund. The Customer must pay the costs of re-delivery.

4. Customised and Made-to-Order Products

4.1 All phone cases are made to order and customised to the Customer’s selected device model.

4.2 Such Products are non-refundable and non-returnable in the event of Customer error, including but not limited to incorrect model selection, change of mind, or order duplication.

4.3 This limitation does not affect the Customer’s statutory rights where the Product is faulty, damaged, or not as described.

4.4 Due to the handmade nature of our Products:

(a) minor variations in colour, finish, or placement are inherent characteristics and do not constitute faults;

(b) where a particular charm or decorative element is unavailable, we reserve the right to substitute a comparable item of equal or greater value without altering the overall design, and such substitutions shall not constitute grounds for return or refund.

5. DIY Kits

5.1 Returns: DIY Kits may be returned within fourteen (14) days of receipt, provided that all components, including the silicone gel, remain unused, sealed, and in original packaging. The Customer bears the cost of return shipping. Refunds will only be issued once the Kit is inspected and confirmed to be complete and unused. Kits that are opened, partially assembled, or incomplete are not eligible for refund.

5.2 Liability: The Charmé Edit warrants only that DIY Kits will be delivered complete and of satisfactory quality. Once a Kit has been opened or assembly commenced, The Charmé Edit is not liable for the final outcome, any damage occurring during assembly, or any issues arising from misuse of silicone gel or other components.

5.3 Safety: DIY Kits contain small parts and are not suitable for children under 3 years. Recommended for ages 12+, with adult supervision required. Silicone gel must not be ingested and should be used only for its intended purpose.

6. Standard (Non-Custom) Products

6.1 For Products that are not customised or made-to-order (excluding DIY Kits), the Customer may return the Product within fourteen (14) days of receipt, provided it is unused, in original packaging, and in resaleable condition.

6.2 The Customer bears the cost of return shipping. Refunds will be issued within fourteen (14) days of receipt of the returned item in acceptable condition.

7. Acceptance of Products

7.1 The Customer must inspect all Products within forty-eight (48) hours of delivery. Unless The Charmé Edit is notified in writing (with photographic evidence) during this period, the Products shall be deemed to have been accepted as delivered, free from defect or damage.

8. Faulty or Damaged Goods

8.1 Nothing in these Terms limits the Customer’s statutory rights under the Consumer Rights Act 2015:

(a) Customers have thirty (30) days to reject faulty goods for a refund;

(b) for up to six (6) months, any fault is presumed to have been present at delivery unless proven otherwise. Remedies may include repair, replacement, or refund.

8.2 The Charmé Edit shall not be liable for:

(a) reasonable wear and tear;

(b) misuse, neglect, or accidental damage;

(c) wilful destruction or modification;

(d) exposure to water, chemicals, oils, solvents, or heat beyond ordinary use;

(e) continued use of a Product after a defect has been detected or should reasonably have been detected.

8.3 Minor surface marks or natural variations occurring through normal use, or slight differences inherent to handmade items, do not constitute faults.

9. Materials, Allergies, and Care

9.1 Products may include silicone gel finishes, metal charms, and other components which may contain trace metals (including nickel). Customers with known allergies or sensitivities should not purchase such items.

9.2 Care instructions must be followed:

(a) avoid bending, peeling, or applying undue pressure to Products;

(b) do not expose to direct sunlight or excessive heat;

(c) avoid contact with chemicals, oils, or solvents;

(d) clean only with a soft, dry cloth.

9.3 The Charmé Edit shall not be liable for defects or damage arising from failure to follow care instructions.

10. Intellectual Property

10.1 All intellectual property rights in The Charmé Edit Products, designs, images, and website content are owned by The Charmé Edit.

10.2 The Customer may not copy, reproduce, adapt, distribute, or create derivative works from any Products or content without prior written consent.

11. Warranties and Liability

11.1 Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or fraud.

11.2 To the fullest extent permitted by law:

(a) The Charmé Edit shall not be liable for indirect or consequential losses, including loss of profits, data, goodwill, or opportunity;

(b) liability for defective Products shall be limited to the repair, replacement, or refund of the Product in question;

(c) our total liability shall not exceed the purchase price of the Product.

11.3 The Charmé Edit is not responsible for defects, damage, or deterioration resulting from wear and tear, misuse, neglect, impact, water, heat, chemicals, or continued use after a defect is apparent.

12. Force Majeure

12.1 The Charmé Edit shall not be liable for any delay or failure to perform obligations where such delay or failure is caused by events beyond its reasonable control, including but not limited to strikes, supply shortages, courier delays, natural disasters, or governmental restrictions.

13. Costs of Enforcement

13.1 The Customer agrees to reimburse The Charmé Edit for all costs, expenses, and charges (including administrative and legal costs) incurred as a result of the Customer’s breach of these Terms.

14. Governing Law

14.1 These Terms are governed by and construed in accordance with the laws of England and Wales.

14.2 Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14.3 This does not affect any mandatory consumer protections available in the Customer’s country of residence.
